"Merck, a U.S. drug maker, on Tuesday won dismissal of a shareholder lawsuit alleging that company officers breached their fiduciary duties in their oversight of the painkiller Vioxx.
The judge in the case, Stanley Chesler of the U.S. District Court in Newark, New Jersey, ruled that the plaintiffs had failed to show that Merck directors were negligent for allowing Vioxx to be developed and sold. He also denied shareholders' request to amend the suit."
